These Terms of Service ("Terms") are a legally binding agreement between you and CASSO SOFTWARE for access to and use of the Cassowebsite, macOS application, and related services (the "Service").
By creating an account, downloading the app, purchasing a license, or using the service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
In short: Casso is a desktop annotation tool run by CASSO SOFTWARE (Australia). Captures stay on your machine. Optional 7-day free trial, then a one-time personal license. You own your local content. Australian Consumer Law rights still apply.
1. Who we are
The Service is operated by CASSO SOFTWARE, a registered business name in Australia. Cassois the product brand. In these Terms, "we," "us," and "our" mean CASSO SOFTWARE.

2. Eligibility
You must be able to form a binding contract and be at least 16 years old (or the age of digital consent where you live, if higher). If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation. You are responsible for the accuracy of information you provide and for activity under your account.
3. The Service
Casso provides a menubar / desktop application for screen annotation and delivery of lean prompts to third-party tools you choose (for example terminals or agent apps). The website provides marketing, account management, authentication, trial and license verification, and purchase flows.
Annotations and captures are designed to remain on your device. We may collect limited website analytics and product telemetry as described in the Privacy Policy to operate and improve the Service; that does not include uploading your screenshots or annotation contents as part of the normal annotate → paste flow. We may modify, suspend, or discontinue parts of the Service with reasonable notice when practical. Features may change over time. The Service is provided on a commercially reasonable, best-effort basis; we do not offer a formal uptime SLA unless we agree to one in a separate written contract.
4. Accounts and security
You must keep credentials confidential and notify us of unauthorised use. We may suspend or terminate accounts that violate these Terms, pose a security risk, or are used for abuse or fraud. You are responsible for activity that occurs under your account until you notify us of a compromise and we have a reasonable chance to act.
5. Free trial
We may offer a free trial of full desktop annotate access (currently 7 days from first successful sign-in on the desktop app). Length and features are shown on the pricing page. When a trial ends, annotate features may lock until you purchase a personal license. Trials are for evaluation by the individual account holder and may not be shared to circumvent licensing.
6. Personal license and payment
Casso is sold by CASSO SOFTWARE as a one-time personal desktop license (not a subscription), for Mac and Windows at the price shown at checkout (for example USD $29 for the 1.x line). We may also offer a free trial as described above. A personal license is for you as an individual; it is not a site-wide or unlimited team license unless we offer that separately.
Free updates may be provided for the major version line you purchased (for example 1.x). A future major version may require a new purchase; we will describe that at the time of sale.
Payments are processed by Stripe. Taxes may apply based on your location and billing details. Except where required by law (including non-excludable rights under the Australian Consumer Law), fees are non-refundable once the license is delivered, though we may grant refunds at our discretion (for example if checkout fails or you were double-charged). Because this is a one-time purchase rather than a recurring subscription, there is no auto-renewal fee unless we clearly offer a different product later.
7. Your content
As between you and us, you retain ownership of content you capture, annotate, or create on your device with Casso (including screenshots, notes, and prompts). We do not claim ownership of that local content.
You are solely responsible for content you capture and paste into other tools, and for having any rights needed to process that content. You grant us only the limited rights needed to operate account, license, and support functions - not a license to use your screen captures for our marketing or AI training.
We do not use Your Content to train AI models. Local captures are not uploaded to our servers as part of the normal annotate → paste flow. If you paste content into third-party agents, those providers may process it under their own terms; that processing is outside the Service.
8. Third-party tools and AI agents
Casso helps you prepare annotated screenshots and prompts for tools you choose (for example CLI coding agents). Casso does not itself generate model completions as part of the core product, and does not host third-party model inference for your captures.
AI disclaimer. Output you receive from third-party AI tools is produced by probabilistic models. It may contain errors, hallucinations, insecure suggestions, or content that is incomplete or inappropriate for your context. Casso is a capture and annotation tool - not a source of verified facts or professional advice. You are solely responsible for verifying any AI-generated suggestions before relying on them, publishing them, or using them in production systems.
Third-party model providers' terms and privacy policies also apply to content you submit to those tools. We are not a party to those agreements and do not control how those providers train, retain, or process data you paste into them.
9. Acceptable use
You agree not to:
- Reverse engineer, resell, or redistribute the desktop app except as allowed by law
- Circumvent license or security controls, or share one personal license in a way that violates these Terms
- Use the Service to violate others' rights, including privacy, or to capture or share content you are not allowed to process
- Submit or process illegal content, including child sexual abuse material or content that exploits minors
- Attack, overload, scrape beyond normal use, or disrupt our infrastructure or third-party services
- Misrepresent identity or affiliation
- Use the Service for high-risk automated decisions about individuals where prohibited by law
We may investigate suspected violations, suspend access, revoke licenses for material breach, and report unlawful activity to authorities when appropriate.
10. Intellectual property
Casso, the Casso mark, website, and software (excluding your local content) are owned by CASSO SOFTWARE or our licensors. Subject to these Terms and a valid license, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the desktop app for personal use. No rights are granted except as expressly stated.
Feedback you provide may be used by us to improve the Service without obligation to you.
11. Third-party services
The Service integrates with or relies on third parties, including (as configured) Stripe for payments, Resend for transactional email, Railway for hosting, Cloudflare for downloads/CDN, PostHog for website analytics, Linear for internal support triage, and any tools you paste into. Those services are governed by their own terms and privacy policies. We are not responsible for third-party outages, policy changes, or how agents use content you send them. A current list of privacy-relevant processors is in our Privacy Policy.
12. Privacy
Our Privacy Policy and Cookie Policy explain how we handle personal information, website analytics, product telemetry, and cookies. By using the Service you acknowledge that processing. The Privacy Policy is incorporated into these Terms by reference.
13. Disclaimer of warranties
Subject to section 14 (Australian Consumer Law) and any other non-excludable rights, the Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that annotations will be compatible with every agent or terminal.
14. Australian Consumer Law
If you are a consumer in Australia, you have rights under the Australian Consumer Law (ACL) that cannot be excluded. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the ACL or any other law that cannot be excluded by agreement.
Where our liability can be limited in relation to goods or services that are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited (at our option) to: for goods - replacement, repair, or the cost of replacement or repair; for services - resupply or the cost of resupply.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW AND SUBJECT TO SECTION 14, CASSO SOFTWARE AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. SUBJECT TO SECTION 14, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE LICENSE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50, IF YOU HAVE ONLY USED A FREE TRIAL.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law, and the above limitations may not apply to you in full. These limitations do not apply to liability that cannot be limited under applicable law, including liability for fraud or reckless conduct where such limitation is prohibited.
16. Indemnity
To the extent permitted by law, you will defend and indemnify us against claims arising from your misuse of the Service, your content (including captures you make or paste into third parties), or your violation of these Terms or applicable law.
17. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or risk to the Service. Provisions that by nature should survive (including ownership, disclaimers, ACL carve-outs, limitations, and indemnity) will survive termination. Paid license rights continue only as described at purchase and may end if we terminate for material breach.
After account closure or a verified deletion request, we will delete or de-identify personal information we hold about you as described in the Privacy Policy, subject to legal retention needs. Local files on your device remain your responsibility to remove.
18. Changes
We may update these Terms by posting a new version on this page and updating the date above. For changes that, in our reasonable view, materially adversely affect your rights, we will try to give reasonable advance notice (for example by email or in-product notice) when practical. Continued use after the effective date constitutes acceptance, except where applicable law requires otherwise.
19. Assignment
You may not assign these Terms without our prior written consent, except to a successor in connection with a merger or sale of substantially all of your assets. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or to an affiliate, with or without notice.
20. Governing law
These Terms are governed by the laws of Australia (and, where applicable, the state or territory in which CASSO SOFTWARE operates), without regard to conflict-of-law rules. Subject to mandatory consumer rights in your country (including the right to bring some claims in your local courts), the courts of Australia will have non-exclusive jurisdiction.
21. General
These Terms, together with the Privacy Policy and any policies linked from them, are the entire agreement between you and us regarding the Service and supersede prior discussions on that subject. If a provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. Notices to you may be sent to the email on your account or posted on the Service. The English version of these Terms controls.
